ARTICLE I (Name)
Section 1. The name of this organization shall be Linux Users Group at San Jose State University.
ARTICLE II (Purpose)
Section 1. The purpose of the Linux Users Group is to support the use and distribution of Linux-based and open source software at San Jose State University and in the local community. The Linux Users Group will aim to provide a forum for students, faculty, and staff to get help on and discuss Linux-related issues.
ARTICLE III (Affiliation)
Section 1. Aside from the responsibilities required under SJSU’s student organization framework, the Linux Users Group at San Jose State University will have no formal affiliation with any group or organization on or off campus. The Linux Users Group may, however, adopt sponsorships or other similar relationships.
ARTICLE IV (Membership)
Section 1. Membership in the Linux Users Group is open to any and all matriculated, currently enrolled students at San Jose State University.
Section 2. The Linux Users Group also welcomes guests from the outside community who have an interest in Linux to participate in events and meetings.
Section 3. At least eighty percent (80%) of all members of the Linux Users Group at SJSU are matriculated, currently enrolled students at San Jose State University.
Section 4. Membership in the organization will not be denied to anyone on the basis of race, religion, national origin, ethnicity, color, age, gender, marital status, citizenship, sexual orientation, or disability. The prohibition on discrimination on the basis of gender does not apply to social fraternities or sororities or to other university living groups. (Title 5, California Code of Regulations, Section 41500).
Section 5. There shall be no hazing.
ARTICLE V (Officers)
Section 1. The officers of this organization will consist of a President, a Vice-President, a Secretary and a Public Relations Officer.
Section 2. The term of office shall be one semester.
Section 3. Elections for officers will be held during the first meeting of the new semester.
Section 4. Vacancies that occur in any of the offices during the course of a semester will be filled by appointment (to be decided by the current President or in the case of an open Presidency, to be decided by the current Vice-President).
Section 5. All officers of this organization are matriculated, currently enrolled students at San Jose State University.
ARTICLE VI (Duties of Officers)
Section 1. The President shall preside at all meetings, name all special committees, see to the general direction of the organization, and strive to seek cohesion amongst the body of the organization.
Section 2. The Vice-President shall assume the duties of the President in his/her absence. The Vice-President shall also act as an aid to the President in all his/her duties, and fulfill roles of other vacant/absent members.
Section 3. The Secretary will take minutes at club meetings, help in the organization and facilitation of special committees, and assist other officers in their duties.
Section 4. The Public Relations Officer will be in charge of recruiting new members and communicating the advantages of Linux and open source software to the local community.
ARTICLE VII (Nominations, Elections and Terminations)
Section 1. The term of office shall be one semester.
Section 2. Elections will take place at the first meeting of each semester.
Section 3. A plurality, not a majority, will be required for officers to be elected.
Section 3. Termination of an officer may be attempted with a written complaint and oral presentation of issues to the active membership. The officer then has until the next meeting to prepare a rebuttal. After his rebuttal there will be the first of three votes. The next two votes will take place during next consecutive meetings. The plurality result of these three meetings will determine the validity of the claim and the termination of the officer. A special election will be held during the final meeting to decide upon a replacement.
ARTICLE VIII (Meetings)
Section 1. Meetings will be held once a week for at least half an hour or depending on event or meeting schedule. This will include planning meetings, presentations, guest speakers and field trips.
Section 2. The President, Vice President, or 10% of the active club membership, have the authority to call special meetings. These must be done within two days of the special meeting.
Section 3. There must be a quorum of at least 75% of the average number of members that have attended the last ten meetings. If a member cannot physically attend then an online chat channel must be setup to reach quorum.
Section 4. The parliamentary authority of this organization shall be Robert’s Rules of Order, Revised.
ARTICLE IX (Committees)
Section 1. The President has the authority to name all committees and committee chairpersons.
Section 2. Committees shall be formed as deemed necessary to perform and fulfill tasks that further the purposes of the club.
ARTICLE X (Dues, fees)
Section 1. The Linux Users Group at SJSU shall collect no dues or fees for membership. Though donations of money and/or equipment will be utilized for club activities.
ARTICLE XI (Amendments)
Section 1. Amendments to the constitution may be presented by any member.
Section 2. Amendments will be presented in writing and voted on at the next club meeting following their introduction and with a minimal tabling time of one week.
Section 3. A two-thirds majority vote of the voting membership is necessary to pass any amendment.
Section 4. The minimum number of participants in an amendment vote shall be five members, at least two of which must be officers.
Section 5. The amendment will become effective immediately following the vote.
